Privacy Policy

Bits & Photons, Inc. · Effective 21 October 2026

This Privacy Policy explains how Bits & Photons, Inc. ("we", "us") collects, uses and shares personal information through our websites and our YieldSpec service, and in our dealings with customers, prospective customers, advisors, suppliers and job applicants. We are a Delaware corporation; our team works mainly from the United Kingdom.

1. Information we process for our customers

YieldSpec reads equipment displays, measurements and production steps from video of our customers' production areas, and that video can show the customer's workers, contractors and visitors. We process this video, and the readings, alerts and reports YieldSpec produces from it, on our customer's behalf and under our agreement with it. The customer decides where cameras are placed and is responsible for informing the people at its site. If you work at or visit a site that uses YieldSpec, please direct questions about your information to that company; we will help it respond.

We use this information only to provide, support and secure YieldSpec for the customer, which includes our staff reviewing and annotating video to set up and check the readings, and to improve our products. Before we use video or readings beyond the customer's own service, we de-identify them so that they no longer identify the customer, its site or any individual, and we do not attempt to re-identify them. YieldSpec works from video only, and our customers agree to switch off audio on the cameras it uses. It does not recognize or identify people from their faces.

The rest of this policy covers the personal information we handle for our own purposes.

2. Personal information we collect

Information you provide. Your name, employer, job title, email address, phone number and other contact details; the content of your messages to us; and, if you are an advisor, supplier or job applicant, your payment and tax details, agreements and CV.

Information from others. Your employer, when it asks us to set up a YieldSpec account or alert for you; our advisors and introducers, when they introduce us to you; and public professional profiles.

Information collected automatically. When you use YieldSpec or our websites: your device and browser type, IP address, the pages you visit, and the actions you take in YieldSpec, including sign-in records. Our websites use only the cookies they need to work, and no analytics or advertising cookies.

3. How we use personal information

We use personal information to:

  • provide, support and improve YieldSpec and our websites, including sending the alerts and reports a customer has set up;
  • communicate with you about our business, including marketing emails to business contacts, which you can opt out of at any time (we do not use the details of YieldSpec users or alert recipients for marketing);
  • manage our relationships with customers, advisors and suppliers, pay them and keep our records;
  • consider job applications;
  • develop new products and features, including by creating de-identified information;
  • keep our services secure, prevent fraud, meet our legal obligations and protect our rights.

4. How we share personal information

We do not sell personal information. We share it only with:

  • service providers that perform services on our behalf, such as cloud hosting, email and office software, text messaging, electronic signature, banking and payments, and AI tools;
  • our customers, for information we process on their behalf, and the people a customer chooses to receive alerts and reports;
  • professional advisers, such as lawyers, accountants and auditors;
  • authorities, where the law requires it or to protect our rights or the safety of others; and
  • a buyer or successor, if our business is reorganized, merged or sold.

5. Your choices

You can opt out of our marketing emails by using the unsubscribe link in any of them or by writing to us; we will still send messages about any service you use. You can ask us, or the customer that set up your account, to update your account details. Because we do not track visitors across other websites, our websites do not respond to "Do Not Track" signals.

6. Other sites and services

Our websites and YieldSpec may link to websites and services run by others. We do not control them and are not responsible for how they handle personal information; please read their privacy policies.

7. Security

We protect personal information with technical, organizational and physical safeguards, and limit access to the people who need it. No method of transmission or storage is completely secure, so we cannot guarantee the security of personal information.

8. International data transfer

We are a US company whose team and service providers operate in the United States and other countries. We store the information we process for our customers in the United States, unless we agree with a customer to store it in its own country. Personal information may be processed in countries, states and other jurisdictions whose data protection laws differ from those where you live. Where the law requires it, we use appropriate safeguards for these transfers.

9. Retention

We keep personal information for as long as we need it for the purposes in this policy: account details while the account is active and for a reasonable period afterwards; business contact details while they remain relevant; agreements, payment and tax records for as long as the law requires; and information we process for a customer for as long as our agreement with that customer provides.

10. Your rights

Depending on where you live, you may have the right to ask us for access to your personal information, to correct or delete it, to receive a copy of it, or to object to or restrict our use of it, and to withdraw any consent you have given. To make a request, write to us at the address below; we may need to verify your identity, and we will not treat you differently for exercising your rights. If your request concerns information we process for a customer, we will pass it to that customer. If you are in the United Kingdom or the European Union, we rely on these legal bases: performing a contract with you or your employer, our legitimate interests in running and improving our business, meeting legal obligations, and your consent where we ask for it; and you may complain to the Information Commissioner's Office (ico.org.uk) or your local data protection authority.

11. Children

Our services are for businesses and are not intended for anyone under 18. If we learn that we have collected personal information from a child, we will delete it.

12. Changes to this policy

We may change this policy from time to time. We will post any change on this page with a new effective date and, for significant changes, tell our customers.
